This Indenture,(U. ~. S. 500 canc'd)
made the twenty seventh day of April in the year one thousand eight hundred and sixty nine Between J. Lawrence Smith Esq. Counselor at Law, of the town of Smithtown County of Suffolk and State of New York, Special Guardian of Robert H. Mount an infant under the age of Twenty one years of the first part and Evelina Mount of the town of Brookhaven in the County and State aforesaid of the second part. Whereas a petition was heretofore presented to the County Judge of Suffolk County in the State of New York by the said Robert H. Mount who is an Infant over the age of fourteen years arid having no general guardian and by George Searing the next friend of the said Robert H. Mount on his behalf praying for the sale of the right title and interest of the said infant in the real estate therein mentioned: and whereas such proceedings were afterwards had In said Court upon the said petition, that by an order of t~ said Court made on the twelfth day, of February 1869 the said J Lawrence Smith was appointed the Special Guardian of the said Infant for the purposes of the said application upon his giving the security therein required, and whereas such security duly approved and acknowledged was subsequently filed by the said guardian in the proper office; and whereas by another order of the said Court made on the seventeenth day of March 1869 the said J. Lawrence Smith was authorized and. Empowered to contract for the sale and conveyance of the right title and interest of the said infant in such real estate at a price not less than that specified in the Referee's Report referred to in said order, and upon the terms and conditions therein mentioned, and 1bihoreas, in pursuance, of the last mentioned order the said special guardian afterwards made his report dated the thirtieth day of March 1869 to the said Court stating that he had entered into an agreement, subject to the approval of the said Court, with Evelina Mount of the town of Brookhaven in the County
and. State aforesaid. For the sale of all the right title and interest of the said infant In and to the said real estate upon the terms and conditions therein mentioned. And whereas by another order of the said Court made on the second day of April 1869 it was ordered that the said report of such special guardian and. The agreement therein mentioned be and the same were thereby ratified and. Confirmed, And whereas it was further ordered by the said Court in and. By the said last mentioned order that the said Special guardian should execute acknowledge and. Deliver to the said Evelina Mount a good and sufficient conveyance of all the estate right title and interest of the said infant in and to the said premises upon her complying with the terms and conditions upon which by the said agreement such deed was to be delivered, and whereas the said Evelina Mount the purchaser aforesaid has complied with the those and conditions of the said agreement, Now therefore this Indenture Witnesseth that the said party of the first part special guardian as aforesaid by virtue of the power and authority conferred upon him by the several orders above mentioned and in pursuance of the statute in such case made and provided for and in consideration of the sum of three hundred dollars to him in hand paid at or before the ensealing and delivery of those presents by the said party of the second part the receipt whereof is hereby acknowledged hath granted bargained so]4 remised released and conveyed and by these presents doth grant bargain sell remise release and convey unto the said party of the second part her heirs and assigns forever, ALL the right title and Interest of the said infant of in and to a certain farm or tract of land with the building and improvements thereon lying in the town of Brookhaven County of Suffolk and State of Hew York formerly the Homestead of Major Jonas Hawkins deceased, ~3ounded
~Northerly by the road leading from Mills Pond. To Setauket, Easterly by the land late of 8a~nuel Thompson deceased and Southerly
by a lane leading from the house of Hugh Byrnes to the intersection of said lane with the highway leading from Stony Brook to New Village, and thence on the South by the highway last mentioned, coming to a point at the West end. Thereof: said tract continuing by estimation Sixty acres be the same more or less. To have and to hold the said premises and every part and parcel thereof with the appurtenances to the said Evelina Mount her heirs and assigns to her and their own proper use benefit and behoof forever.
